**HIPAA and Medical Research** The Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule has been reported to negatively impact medical research in several ways. Researchers have found that the Privacy Rule increases the cost and time required to conduct a research project from start to finish.23 Additionally, it has been reported to negatively affect research recruitment, the Institutional Review Board (IRB) approval process, and the use of de- identified information.23 Surveys conducted by various organizations, including the Institute of Medicine (IOM) committee, have shown that 75 percent of respondents reported negative experiences with the Privacy Rule, and only 6 percent reported positive experiences.23 The Privacy Rule has also been linked to delays in research, with 55 percent of respondents reporting that study timelines were negatively affected, and a third of the investigators indicating that the Privacy Rule delayed their research by 1 to more than 3 months.3 Moreover, the Privacy Rule has been reported to increase the number of staff hours required to comply with its requirements, with 12 percent of respondents reporting that 100 or more staff hours were required, and one extreme case reported compliance with HIPAA procedures required about 1,000–2,000 additional hours of staff time, adding $100,000–$200,000 in unanticipated costs.
